Felony Murder[edit]

Please make sure you actually *understand* the felony murder rules used against Tate before editing that section. Under these rules Tate was convicted without the prosecution having to prove that he intended to kill or injure, or realized that his acts are likely to kill or injure, or even that a typical child of his age would or should realize this.

Pro wrestling Defense[edit]

Why no mention of the fact of his defense was thrown out? Or that it turned out later to have been basically invented by Tate's attorney or any of the aftermath involving WWE settling with the PTC for three million dollars regarding what was said in a video that the PTC sent to WWE's advertisers that was produced by them and included Tate's lawyer? Okay maybe WWE's slander suit against the PTC might not be relevant, but the facts that he wasn't watching pro wrestling, had a history of aggression before this happened and even when he was in custody, should be. Adult or juvenile prison[edit]

There's no mention in the article as to whether he went to adult prison or juvenile hall after his convection at 14. Is it that if a juvenile is tried as an adult in the US then he will automatically go to adult prison upon conviction? 83.226.206.82 (talk) 22:34, 10 March 2009 (UTC)[reply]

Kids in Florida (and AFAIK the rest of the U.S.) go to ADULT jail automatically upon being charged "as adults" -- so of course they go to ADULT prison upon conviction if it includes a prison. Typically there are bans on mixing with ADULT inmates before conviction and some restrictions after conviction, but the institutions are designed for adults, not children; in Florida children as young as 13 were mixed freely with adult inmates until about 2001 when some restrictions were implemented due to newspaper exposes of the abuses suffered by child inmates in Florida's adult prisons. Tate's conviction came soon after these exposes and perhaps partly because of that he was transfered to juvenile prison after several weeks. If I find reference to that I'll add it to the article. Request for update[edit]

I am not a regular Wikipedia editor, but the final line of the article where it states Tate is currently incarcerated at Charlotte is incorrect. According to the FDC website he is at Hamilton C.I.
